1.1 KEEN Wellbeing

We are KEEN Wellbeing ("KEEN," "we," "us"), located at Viaduktstrasse 25, 8004 Zurich, Zurich. For any questions or concerns, you can reach us at hello@keenwellbeing.com. KEEN provides wellness spaces focused on Active Recovery through classes, workshops, and treatments such as breathwork, sauna sessions, ice baths, and guided movement practices. Our mission is to make active recovery accessible to support physical and mental well-being.

1.2 Our Services

KEEN offers individual sessions, memberships, and events. Details on the scope of our services and pricing can be found on our website www.keenwellbeing.com. The prices valid at the time of purchase/booking apply.

1.3 Bookings

Bookings can be made online via the KEEN Website, by phone, or on-site. By booking a service, you agree to these GTC, which govern your relationship with KEEN.

2. Scope of the GTC

2.1 General

These GTC regulate the legal relationship between KEEN and you as the customer. They apply to all services provided by KEEN unless otherwise agreed in writing.

2.2 Contracting Parties

You and KEEN are collectively referred to as the "Parties." KEEN may collaborate with third-party service providers to deliver its offerings. However, this does not affect your contractual relationship with KEEN.

3. Eligibility

3.1 Individual Requirements

Our services are intended for private individuals aged 18 and above. By accepting these GTC, you confirm that you meet the eligibility requirements.

3.2 Exclusion Criteria

KEEN’s services are designed for individuals without contraindications such as severe cardiovascular issues, pregnancy (for ice baths), or other medical conditions outlined in the participant waiver. KEEN reserves the right to refuse service based on medical concerns or other reasonable grounds.

4. Booking and Memberships

4.1 Booking Process

You can book appointments via the KEEN Website, by phone, or on-site. Bookings are confirmed upon receipt of payment and KEEN’s written confirmation.

4.2 Membership and Subscriptions

KEEN offers various membership types, including:

Event Memberships: Includes access to events.

Subscriptions: Focuses on group classes and solo journeys.

The scope, duration, and pricing for memberships are detailed on our website or provided at the time of booking.

4.3 Cancellations and Refunds

By the Customer: Cancellations must be made at least 24 hours before the appointment to avoid charges. Late cancellations are deducted from the customer account. 

By KEEN: KEEN reserves the right to reschedule or cancel sessions due to unforeseen circumstances. Customers will be offered an alternative or a full refund.

5. Payments

5.1 Payment Terms

Payments for services must be made at the time of booking or in advance for memberships.

5.2 Payment Methods

We accept payments in Swiss Francs (CHF) via credit card, bank transfer, or other methods specified on the KEEN Website.

5.3 Late Payments

In case of late payment, the customer is obliged to pay default interest of 5% per annum. If the customer is more than one month in arrears with payment, KEEN reserves the right not to provide any services until full payment is made.

6. Customer Responsibilities

6.1 Providing Accurate Information

You agree to provide accurate health and contact information when using KEEN’s services.

6.2 Compliance

You agree to follow KEEN’s safety guidelines and instructions during activities. KEEN is not liable for injuries resulting from non-compliance.

7. Liability

7.1 General Liability

KEEN is not responsible for injuries or damages resulting from the use of its facilities or services unless caused by gross negligence.

7.2 Health Risks

Participation in KEEN’s activities is at your own risk. Consult your physician if you have concerns about your ability to safely engage in our services.

8. Data Protection

KEEN processes your personal data in accordance with Swiss data protection laws. For details, please refer to our Privacy Policy.

9. Final Provisions

9.1 Changes to the GTC

KEEN reserves the right to amend these GTC. Changes will be communicated via email or the KEEN Website and are deemed accepted unless you object in writing within 30 days.

9.2 Severability

If any provision of these GTC is deemed invalid, the remaining provisions shall remain enforceable.

9.3 Governing Law and Jurisdiction

These GTC are governed by Swiss law. Disputes shall be resolved in the courts of Zurich.

2. Eligibility

2.1 You must be at least 18 years old to access and use KEEN’s services, or you must have the consent of a parent or guardian if you are under 18.

2.2 By using KEEN’s services, you confirm that you are physically and mentally fit to participate. If in doubt, consult a healthcare professional before engaging in any activities.

3. User Responsibilities

3.1 Adherence to Guidelines: You agree to follow all instructions, safety guidelines, and policies provided by KEEN staff during activities and when using facilities.

3.2 Accuracy of Information: You are responsible for providing accurate and truthful personal and health information when required.

3.3 Respect for Property and Others: Users must respect KEEN’s property, staff, and other participants. Any damage caused intentionally or through negligence will result in liability for repair or replacement costs.

4. Permitted Use

4.1 Personal Use: KEEN’s services and website are intended for personal, non-commercial use only.

4.2 Prohibited Activities: Users may not:

Engage in disruptive, harmful, or illegal activities while on KEEN premises or using KEEN services.

5. Bookings and Cancellations

5.1 Booking: Appointments and memberships must be booked via KEEN’s website, app, phone, or on-site. Bookings are subject to availability and confirmation.

5.2 Cancellation: Users must notify KEEN at least 24 hours in advance for cancellations to avoid charges. KEEN reserves the right to charge a cancellation fee for late cancellations or no-shows.

5.3 Rescheduling: KEEN may reschedule appointments due to unforeseen circumstances and will notify users promptly.

6. Health and Safety

6.1 Participation in KEEN’s activities is voluntary and at your own risk. KEEN does not provide medical advice or treatment.

6.2 You must disclose any relevant medical conditions before participating in activities.

6.3 If you experience discomfort or health issues during a session, inform KEEN staff immediately and cease participation.

7. Limitation of Liability

7.1 KEEN is not liable for injuries, accidents, or damages arising from your use of its facilities or services unless caused by gross negligence or willful misconduct.

7.2 KEEN is not responsible for the loss or theft of personal belongings on its premises.

8. Intellectual Property

8.1 All content provided by KEEN, including branding, materials, and digital content, is protected by intellectual property laws.

8.2 Users may not reproduce, distribute, or exploit KEEN’s intellectual property without prior written consent.
